Terms of Service

These Terms of Service ("Terms") govern access to and use of the Swile platform, websites, and APIs (the "Service") operated by Swile SAS. By creating an account or placing an order you agree to these Terms. If you are entering into these Terms on behalf of a company, you represent that you have authority to bind that company.

1. Eligibility & account

The Service is for business use by users aged 18 or older. You are responsible for keeping account credentials confidential and for all activity under your account. Notify us immediately of any unauthorized access at [email protected].

2. Credits & pricing

  • The Service is pay-as-you-go. There are no subscriptions, trials, or auto-renewals.
  • Base price is €0.10 per credit. Minimum purchase is 50 credits.
  • Other currencies are converted from EUR at ECB reference rates at the time of checkout and shown as indicative amounts on the invoice.
  • Credits are added to your account after payment is received and do not expire.
  • Actions in the Service consume credits as documented in-product. Credit consumption is final once an action is executed.
  • Prices exclude applicable taxes and duties, which will be added where required.

3. Orders & payment

Orders are placed via checkout. For bank transfers, credits are added once funds are received (typically 1–2 business days). Card, PayPal and Stripe methods are added as they become available. All fees are non-refundable except as stated in our Refund Policy.

4. License

Subject to these Terms and payment of credits, Swile grants you a non-exclusive, non-transferable, revocable right to access and use the Service for your internal business purposes.

5. Customer data & AI outputs

You retain all rights in the data you upload ("Customer Data"). You grant Swile a license to process Customer Data solely to provide and secure the Service. You are responsible for ensuring you have the right to upload and use Customer Data.

AI outputs (such as generated emails and enrichment) are provided "as is". You are responsible for reviewing outputs before sending them to third parties and for compliance with anti-spam and data-protection laws.

6. Acceptable use

Use of the Service is subject to our Acceptable Use Policy. Violations may result in suspension or termination without refund.

7. Intellectual property

Swile and its licensors own all rights in the Service, including software, models, databases (excluding your Customer Data), and branding. You may not copy, reverse engineer, or resell the Service.

8. Warranties & disclaimers

The Service is provided on an "as is" and "as available" basis. Swile does not warrant that data will be error-free, complete, or uninterrupted. Match rates and accuracy figures are indicative and depend on your inputs.

9. Limitation of liability

To the maximum extent permitted by law, Swile's aggregate liability arising out of or related to the Service will not exceed the fees paid by you in the six months preceding the claim. Swile is not liable for indirect, incidental, special, consequential, or exemplary damages.

10. Suspension & termination

You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms, non-payment, or abuse. Unused credits tied to a terminated account are governed by the Refund Policy.

11. Governing law

These Terms are governed by the laws of France. Any dispute will be submitted to the exclusive jurisdiction of the competent courts of Montpellier, France, without prejudice to mandatory consumer protections.
